Cashless gaming and mobile integration are reshaping tribal casinos, but with innovation comes heightened regulatory scrutiny. To understand this, we sat down with Sam Basile, an experienced gaming attorney and compliance expert at GeoComply, to discuss what tribal operators need to know.

Sam Basile, VP, Business Development & Licensing

Q: Why is compliance with AML, OFAC, CTF, and SARs so critical for tribal casinos today?

Sam Basile: That’s quite the digital alphabet soup!  The landscape of NIGC rules is evolving, but federal laws have already been established. Tribal casinos must be prudent when adopting digital wallets and omnichannel gaming. Although these technologies offer greater convenience for players, they also create opportunities for bad actors to engage in money laundering, fraud, and even terrorist financing. Compliance is not simply a recommendation—tribal casinos earning over $1 million annually must understand these terms and strengthen their Title 31 programs to mitigate these risks.

Q: What does AML (Anti-Money Laundering) compliance mean for tribal casinos?

Sam Basile: AML laws are designed to prevent criminals from disguising illegally obtained funds as legitimate earnings. Tribal casinos must have robust AML programs to detect and report suspicious activities. Without them, they risk hefty fines and potential enforcement actions from agencies like FinCEN (Financial Crimes Enforcement Network), adding one more acronym to the digital alphabet soup.

Q: How does OFAC (Office of Foreign Assets Control) impact tribal gaming?

Sam Basile: OFAC enforces U.S. economic sanctions, meaning tribal casinos must ensure they aren’t doing business with sanctioned individuals, entities, or countries. Violations—intentional or not—can result in massive penalties. With the rise of digital transactions, enhanced geolocation is crucial to ensure users aren’t attempting to fund mobile cashless wallets using technology that masks their sanctioned locations.

Q: What is CTF (Counter-Terrorist Financing), and why should it be a priority?

Sam Basile: Federal laws prioritize the detection and prevention of terrorism financing in tribal casinos. Counter-Terrorism Financing measures aim to identify and prevent funds from being used for terrorist activities, which can be detectable based on their origin or the sender’s location, particularly in state-sponsored areas.  To mitigate this risk, tribal casinos that offer mobile cashless wallets will need to monitor all funding transactions in near real-time to identify and block these high-risk transactions.

Q: SARs (Suspicious Activity Reports) seem complex. What do tribal casinos need to know?

Sam Basile: SARs are reports that casinos must file with FinCEN when they detect suspicious transactions related to money laundering or financial crimes. Failure to file timely and accurate SARs can result in serious penalties. Mobile cashless gaming increases the risk of multiple account fraud, proxy betting, and chargeback fraud, making real-time monitoring even more essential.

Q: How can tribal casinos ensure compliance while adopting cashless gaming?

Sam Basile: The key is strong risk management and advanced technology. GeoComply helps tribal operators navigate these challenges with:

  • Enhanced geolocation: Ensures digital transactions are securely tied to verified player locations, blocking high-risk jurisdictions and VPN users.
  • Fraud prevention: Detects unauthorized transactions, account takeovers, and suspicious behavior in real-time.
  • AML/CTF compliance tools: Monitors transactions for red flags, helping casinos stay ahead of regulatory requirements.
Q: Where can tribal casino operators learn more?

Sam Basile: I encourage anyone who wants to learn more to meet with us at the Indian Gaming Tradeshow & Convention. We’d love to discuss how GeoComply can help your casino stay ahead of financial crime risks.
